Barany Consulting (the “e‑Course Organizer”) welcomes you to the a 30-Day or 15-Day Writing/Marketing Challenge (in this document all will be referred to as the “e‑Course”). Your presence and/or participation in the e‑Course is your acknowledgment that you have read, understand, and agree to be bound by the terms and conditions explained below (the “Terms”).

No privileged relationship formed. Nothing in any oral or video presentation offered during the e‑Course, nor anything in any written materials distributed by any speaker, is to be construed as legal, therapeutic, spiritual, or any other form of advice. All e‑Course content is for information and educational purposes only. Nothing that occurs during the e‑Course should be construed as creating a privileged or confidential relationship between YOU, any presenter, and/or the e‑Course Organizer.

Confidentiality. Participants may share private, personal or business matters during the course of the e‑Course, however nothing discussed during e‑Course should be shared with anyone outside unless you have the explicit written agreement from the person whose info you’re sharing.

Results are not guaranteed. With respect to the reliability, accuracy, timeliness, usefulness, adequacy, completeness, or suitability of information provided during the e‑Course, the e‑Course, e‑Course Organizer, its partners, associates, affiliates, consultants, and/or presenters make no warranties, representations, or claims of any kind.

Participant results vary based on many factors, including but not limited to participant’s willingness and ability to follow all instruction. Participating in the e‑Course does not guarantee your success or any business or financial results; nor does it guarantee that you will secure financial backing based on your finished business plan. This e‑Course is not a substitute for legal, financial or other expert guidance. Please consult legal and financial experts.

Copyright. The e‑Course and the e‑Course Organizer claim a copyright in the continuing education resources they present and offer during the e‑Course (the “Resources”). These Resources are meant to enhance your personal learning experience. You may reproduce the materials for your own personal use; you may not reproduce these Resources for any third party, in whole or in part, for commercial or non‑commercial use, without the express, written permission of the e‑Course Organizer or any other copyright holder. Further, you are not permitted to record the e‑Course, in whole or in part, using any form of technology now known to exist or later developed, except as permitted for your personal use.

Limitation of liability. Although the e‑Course makes reasonable effort to provide a safe learning environment, please understand that there are never any guarantees. Your safety is your concern and responsibility. Under no circumstances shall the e‑Course, e‑Course Organizer, or its partners, associates, affiliates, consultants, and/or presenters be liable to you or anyone else, as a result of injury or damage to your person, or your belongings.

Further, the e‑Course cannot and does not warrant against human and machine errors, omissions, delays, interruptions or losses, including loss of data to your laptop, PDA, MP3, or other data storage unit. It is your responsibility to protect yourself and your personal items. These Terms supersede any other statement or document you may be asked to sign with respect to the e‑Course and the e‑Course Organizer’s limitation of liability.

Permission to record and use. By participating in the e‑Course, you grant to the e‑Course Organizer, and its partners, associates, affiliates, consultants, and/or presenters the right to record your image, voice, and likeness, and you further grant to them an irrevocable, perpetual, worldwide right to reproduce, display, perform, distribute, adapt, repurpose, and promote this content in connection to this e-Course, and other similar courses. You will not be compensated for any such use. The e‑Course, and its partners, associates, affiliates, consultants, and/or presenters own all right, title to, and interest in any compilation, collective work and/or other derivative work created by the e‑Course, not by the participants, using or incorporating content by us created during the e‑Course. You own and retain all copyright to the work you may share and create during the course. We are not requesting rights to that material.

Indemnification. You agree to defend, indemnify and hold harmless the e‑Course Organizer from any claims, damages, costs and expenses, directly or indirectly resulting from, or caused by, either your failure to comply with the Terms set forth herein, your participation in the e‑Course, any intentional or negligent behavior of any e‑Course attendee, any result or lack of desired result you may have anticipated, or any negligence on the part of the Course Organizer before, during, or after the e‑Course.

If you are asked to not participate in this e‑Course because you violated the Terms of this agreement, you forfeit your right to any and all guarantees, and your enrollment fees will not be refunded. You represent and warrant that you are over 18 years of age and fully competent and authorized to enter into this agreement on behalf of yourself. By agreeing to this release you assert that you have carefully read, understand, and agree to be bound by the Terms, as set forth above. If you have any questions about your obligations hereunder, you should contact the e‑Course Organizer to clarify your questions.
